1. About Fine Themes
Fine Themes ("we", "us", "our") is a web design company incorporated in Ontario, Canada, operating under the laws of Canada and the Province of Ontario. Our registered business address is in Toronto, Ontario. By using our website or services, you ("Client", "you") agree to these Terms & Conditions in full.
2. Services
Fine Themes provides website design, development, copywriting, and related digital services. Specific deliverables, timelines, and pricing for each engagement are outlined at the time of order or in a separate project agreement. We reserve the right to refuse service to anyone for any reason.
3. Preview & Approval
We provide a website preview before requesting payment. By approving the preview and making payment, you confirm that the deliverable meets your requirements. Unlimited revisions are included prior to payment. After payment, additional change requests may be subject to additional fees.
4. Payment
Payment is processed securely via Stripe. All prices are in Canadian Dollars (CAD) unless stated otherwise. Payment is due upon approval of the final website preview. We do not store your payment card details. Applicable taxes (HST) will be added where required by law.
5. Refund Policy
Because you review and approve your website before paying, we do not offer refunds after payment is made. If you are unsatisfied with the preview at any stage before payment, you are under no obligation to proceed and owe nothing.
6. Intellectual Property
Upon receipt of full payment, you own the final website content, copy, and design delivered to you. Fine Themes retains the right to display completed work in its portfolio unless you request otherwise in writing. Third-party assets (stock images, fonts, plugins) remain subject to their respective licences.
7. Client Responsibilities
You are responsible for providing accurate business information, responding to our requests in a timely manner, and ensuring that any content, logos, or images you supply do not infringe third-party rights. Fine Themes is not liable for delays caused by the client's failure to provide required materials.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Fine Themes shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability to you for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.
9. Warranties
We warrant that services will be performed in a professional and workmanlike manner. We do not warrant that websites will be error-free or uninterrupted after delivery. All other warranties, express or implied, are disclaimed to the fullest extent permitted by law.
10. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Ontario, Canada.
12. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Continued use of our services after changes constitutes acceptance of the new Terms.
